This document contains the Terms and conditions for the provision of sale of products and services by Aggarwal Art and Pattern. Each and every customers or purchaser of your products and services must agree to be bound by the following Terms and Conditions.
Terms of Payment
They following is the payment structure to be followed:
Payment mode is a subject of final dealing and as per final Performa invoice.
Our company provides excellent transportation facility in the Delhi NCR vicinity. We have collaborated with transport companies like VRL, V-Trans, Gati and many other local transport services keeping in mind client’s preferences in order to provides good transportation services to our interstate clients. Material Insurance and safety is under transport company scope.
Our prime focus is on the timely delivery of our products to the clients. For Instant and fast delivery, we have stock ready in bulk. We supply the components in compliance with a detailed Program of Work to be submitted by us as agreed by both the parties after receipt of clear Purchase order and Advance Payments. Further, orders we take shall require around 3-10 Working days after confirmation or as per commitment at the time of booking the order.
We have a specialised QC department, whose sole purpose is to do Quality check. We ensure high quality material is used in our factory, PVD finish/colour shade may vary from Solid to Pipes.
Aggarwal Art and Pattern shall not be liable for non-performance of obligations either wholly or in part, nor for any delay in performance, resulting from or due to any cause beyond the company’s control including fires, strikes, pestilence, dispute with workmen, war, riots civil commotion, epidemics, flood, accidents, damage or accident to machinery, shortage of wagons/trucks/trailers, shortage of fuel or other materials, shortage of power or other energy, shortage of labor, acts, demands or requirements of Government agencies or bodies, or any other circumstances beyond the control of the company, whether directly due to or in consequence of the aforesaid causes or not, and the existence of such causes or consequences shall operate to extend the time of performance on the part of the company by such period as may be necessary to enable the company to effect performance after the cause of delay shall have ceased to exist. Should the company so determine, it shall be entitled at any time without any notice to the customer to cancel the arrangements/subsequent contract, the performance of which is likely to be delayed by any of the causes aforesaid and the customer shall have no claim upon Aggarwal Art and pattern of any kind?
On the issuance of Work Order and on entering into a formal Agreement Aggarwal Art and Pattern and the CLIENT or otherwise, if any, dispute or difference arises out of or relating to the said Work order/contract the same shall be resolved amicably by the parties, failing such amicable resolution of dispute/differences either party may refer the matter to arbitration of a Sole Arbitrator to be appointed mutually by the parties. In case the CLIENT and Aggarwal Art and Pattern do not agree to a common name for being appointed as the Sole Arbitrator then parties shall nominate one Arbitrator each and both the Arbitrators so appointed by the parties shall select the third Arbitrator who shall act as the Presiding Arbitrator. The award of the majority shall be final, binding and conclusive on the parties. The venue of the Arbitrator shall be Delhi. The Arbitration proceedings will be governed and regulated by the provisions of Indian Arbitration & Conciliation Act, 1996 and the rules framed there under.
